When you use our mobile application (the “App”) and generally, use any of our services (the “Services,” which primarily include the App), we appreciate that you’re trusting us with your personal information. We take your privacy very seriously. In this privacy notice, we explain as clearly as possible what information we collect, how we use it, and what rights you have. Please take some time to read it carefully; it’s important. If you don’t agree with any terms in this privacy notice, please stop using our Services immediately.

This privacy notice applies to all information collected through our Services (mainly our App), as well as any related services, sales, marketing, or events.

1. WHAT INFORMATION DO WE COLLECT?

In Short: We collect personal information you provide to us, information related to your subscription, and data that is collected automatically when you use the App.

Personal Information You Disclose to Us

We collect personal information you voluntarily provide when you register, express interest in our Services, participate in activities within the App, or contact us. This includes:

  • Identifiers: Name, email address, username, password, and contact preferences.
  • Subscription and Payment Information: When you subscribe to our Services, we collect information necessary to process your payment, such as your billing address. However, your full payment card details (debit/credit card numbers) are collected and processed directly by our third-party payment processor, Stripe, and are never stored on our servers.
  • Social Media Login Data: If you register using a social media account (like Google), we collect profile information as described in the “HOW DO WE HANDLE YOUR SOCIAL LOGINS” section.

All personal information you provide must be true, complete, and accurate, and you must notify us of any changes.

Information Automatically Collected

We automatically collect certain information when you use the App. This information does not reveal your specific identity but may include device and usage data. This includes:

  • Log and Usage Data: IP address, device information, operating system, app activity (date/time stamps, features used, searches), error reports, and hardware settings.
  • Mobile Device Data: Device ID, model, manufacturer, and mobile carrier.
  • Location Data: We may collect precise or imprecise location data if you grant us permission. You can opt out at any time by changing your device’s settings, but this may disable location-based features.

2. HOW DO WE USE YOUR INFORMATION?

In Short: We process your information for legitimate business interests, the performance of our contract with you, compliance with legal obligations, and with your consent.

We use the information we collect to:

  • Facilitate account creation and logon.
  • Manage your subscription and process payments. We use your information to fulfill and manage your subscription, including payments, renewals, and cancellations, made through the Services.
  • Manage user accounts and keep them in working order.
  • Send administrative information, such as updates to our services, terms, and policies.
  • Protect our Services through fraud monitoring and prevention.
  • Enforce our terms and policies.
  • Respond to legal requests and prevent harm.
  • Deliver and facilitate the delivery of services, such as generating recipes and providing support.
  • Send you marketing and promotional communications, which you can opt out of at any time.
  • Deliver targeted advertising and measure its effectiveness.
  • For other business purposes, such as data analysis, identifying usage trends, and improving our Services. We may use this information in an aggregated and anonymized form.

3. HOW DO WE USE ARTIFICIAL INTELLIGENCE?

In Short: Our Services leverage AI to generate recipes and personalized suggestions. Your queries are used to power this, but we do not use your personally identifiable information to train our models.

  • Input Data for AI Generation: When you submit a query (e.g., “spicy chicken recipe”), that text is sent to our AI models (which may include Google’s AI models, such as Gemini) to generate a response.
  • No Personal Data Training: We do not use your personally identifiable information (like your name or email) to train our core AI models. Interaction data may be logged for service improvement and troubleshooting.
  • Service Improvement & Fine-Tuning: Aggregated and anonymized data from AI interactions may be used to improve the performance and accuracy of our AI. If you contribute recipes or articles to our database, that content may be used (in an anonymized context) to fine-tune and improve the AI’s future responses for all users.
  • Data Security: All data exchanged with our AI systems is protected by the robust security measures detailed in the “HOW DO WE KEEP YOUR INFORMATION SAFE?” section.

4. WILL YOUR INFORMATION BE SHARED WITH ANYONE?

In Short: We only share information with your consent, to comply with laws, to provide you with services, or to fulfill business obligations. We do not sell your personal information.

We may share your data in the following situations:

  • Payment Processors: We share transaction data with our payment processor, Stripe, Inc., to process your subscription payments, prevent fraud, and manage billing disputes. Stripe’s use of your personal data is subject to its own privacy policy.
  • AI Service Providers: We may share your non-personally identifiable queries with our technology partners, such as Google, who provide the underlying AI models that power our recipe generation features.
  • Legal Obligations: We may disclose your information where legally required, such as in response to a subpoena or court order.
  • Business Transfers: Your information may be shared or transferred in connection with a merger, sale of company assets, or acquisition.
  • Affiliates: We may share your information with our parent company, subsidiaries, or other companies under common control, who are required to honor this privacy notice.

5. HOW DO WE HANDLE YOUR SUBSCRIPTION & PAYMENT INFORMATION?

In Short: All payments are processed securely by Stripe. We do not store your credit card details.

When you subscribe, you provide your payment information directly to Stripe. Stripe is a PCI-DSS Level 1 compliant payment processor, meaning they adhere to the highest standards of data security. Your payment data is encrypted and stored securely in their vault. We receive a token from Stripe to reference your account for recurring billing, but we do not have access to your full debit/credit card number.


6. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We may use tracking technologies within the App to collect and store information for analytics and functionality.

We may use cookies and similar tracking technologies (like pixels) to access or store information. These are primarily used to understand app usage, maintain your session, and ensure the security of our Services.


7. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

In Short: If you log in using a social media account, we may access certain profile information.

If you use a third-party social media account (like Google) to log in, we will receive profile information from that provider, which often includes your name and email address. We use this information only to facilitate your login and for the purposes described in this notice. We do not control how your social media provider uses your data.


8. WHAT IS OUR STANCE ON THIRD-PARTY WEBSITES?

In Short: We are not responsible for the safety of information you share with third parties linked from our App.

The App may contain links to other websites or services. We cannot guarantee the safety and privacy of data you provide to any third parties. This privacy notice does not cover data collected by them.


9. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information as long as your account is active, and for a longer period where required by law.

We will keep your personal information for as long as you have an account with us. When you delete your account, we will delete or anonymize your information from our active databases.

However, we will retain certain data for longer periods to comply with our legal obligations, such as:

  • Subscription and transaction data will be retained for at least seven (7) years to comply with tax and financial accounting laws.

10. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We use a system of organizational and technical security measures to protect your information.

We have implemented appropriate security measures to protect your personal information. However, no electronic transmission or storage technology is 100% secure. Transmitting personal information to and from our Services is at your own risk.


11. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: You may review, change, or terminate your account at any time.

Account Information

You can review or change your account information, or terminate your account, by:

  • Logging into your account settings within the App.
  • Contacting us using the contact information provided.

Upon your request to terminate your account, we will deactivate or delete it from our active databases. This action will also cancel your active subscription at the end of the current paid term. Please note that some information (e.g., transaction data) will be retained in our files for legal and financial compliance as described above.


12. CONTROLS FOR DO-NOT-TRACK FEATURES

We do not currently respond to Do-Not-Track (โ€œDNTโ€) browser signals or similar mechanisms as no uniform technology standard has been finalized.


13. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: Yes, California residents are granted specific rights regarding access to and control of their personal information under the California Consumer Privacy Act (CCPA).

How do we use and share your personal information?

We use and share this information as described in the sections above. We may disclose your personal information with our service providers (like Stripe and Google) pursuant to written contracts. This is necessary for our business purposes and is not a “sale” of your data under the CCPA. Chefy has not sold and will not sell any personal information to third parties.

You have the right to request deletion of your data, the right to know what data we collect, and the right to non-discrimination for exercising your privacy rights. To exercise these rights, please contact us at ccpa@chefyai.com. We will verify your identity before processing your request.
